A committee was constituted to frame drat Regulations for BBMB own recruited Class-I & II officers. After submission of report by the committee draft Regulations were placed before the Board in 212th & 213th meeting. Now after complying with the observations of the Board these are to be again placed before the Board in the next meeting.
However, before placing the draft Regulations in Board’s next meeting in view of approval of Chairman, BBMB, you are requested to put the draft Regulations on Web (in English & in Hindi) requesting all concerned to send their comments within 10 days for taking further necessary action in the matter.

In exercise of the powers conferred by sub-section (9) of Section 79 of the Punjab Re-organization Act, 1966 (31 of 1966) (hereinafter referred to as the said Act), the Bhakra Beas Management Board, with the approval of the Central Government hereby makes the following regulations regulating the recruitment and conditions of service of Class I & II of the Bhakra Beas Management Board Regular employees namely:-
1. Short title, commencement and application:- (1) These regulations shall be called the BBMB Class-I & Class-II Officers (Recruitment & Conditions of Service) Regulations, 2012.
(2) They shall come into force from the date of their publication in the Official Gazette by Government of India, Ministry of Power.
(3) They shall apply to the following:-
(i) all existing regular employees who have been recruited by the Board before coming into force of these regulations.
(ii) the employees appointed by the Board hereinafter under these regulations as contained in Schedule „A‟
2. Definitions: (1) In these regulations, unless the context otherwise requires:-
(a) “Appointing Authority” means the authority empowered to make appointment to any post in the group of posts as mentioned in Schedule „A‟ annexed with these regulations;
(b) “Board” means the Bhakra Beas Management Board constituted under Section 79 read with Sub-section (6) of Section 80 of the said Act.
(c) “Cadre” means strength of category of posts permanent and temporary in a service/in a particular group or part thereof;
(d) “Chairman” means the whole-time Chairman of the Board appointed under clause (a) of sub-section (2) of Section 79 of the said Act;
(e) “Direct recruitment” means an appointment made in accordance with these Rules by selection on the recommendations of the Selection Committee or by the concerned appointing authority; otherwise than by promotion of an employee governed under these Regulations.
(f) “Employee” means an employee of the Board to whom these regulations apply;
(g) “Head of the Department” means a Chief Engineer specified by the Board to be the head of the Department, the Financial Adviser and Chief Accounts Officer of the Board or any other officer declared as Head of the Department by the Chairman as the case may be;
(h) “Head Office” means Board‟s Secretariat Office, Offices of the Chief Engineers and the Financial Adviser and Chief Accounts Officer as the case may be:
(i) “Head of Office” means the head of the respective office of the Board as may be declared by the Chairman;
(j) “Probation” means appointment of an employee against a regular vacancy for a specific period to test his suitability for the post;
(k) “Promotion” means elevation of an employee of the Board from one post to another other than ex-cadre involving higher duties and responsibilities;
(l) “Recognized University or Institution” means:-
(i) any University or Institution incorporated by law in any of the States of India; or
ii) any other University which is declared by the Government to be a recognized or deemed University or Institution for the purpose of these regulations;
(m) “Rules‟ means the Bhakra Beas Management Board Rules, 1974;
(n) “Secretary” means the Secretary or the Special Secretary to the Board;
(o) “Selection Committee” means Union Public Service Commission or similar Organization for making selection of candidates for appointment to the various Class I & Class II posts in the Board;
(p) “Service” means the service of the Board and shall comprise groups of various classes of posts shown in Schedule „A‟ annexed with these regulations;
Provided that the Chairman shall be competent to make addition to or deletion of, or substitution of any post(s) in a group or add new group (s) in the Schedule „A‟ annexed with these regulations, when considered expedient to do so depending upon the work load;
(q) “Transfer” means:-
(i) in relation to the employees of the Board, transfer within the jurisdiction of the Board;
(ii) change over from one sub-group/group of service to another sub-group/group of service;
(iii) placing the service of their employees at the disposal of the Board by the Government Departments and the State Electricity Boards/Power Utilities of the Partner State Governments.
(2) Words and expressions used herein but not defined shall have the same meaning as assigned to them in the codes, rules, manuals, orders, regulations and the like specified in Schedule-I to the Rules - 1974.
3. General conditions of employment:- There shall be integrated cadre of similar categories of posts existing in all the Wings of BBMB except in the Engineering cadre, where the cadre will be maintained wing wise. All the employees shall be governed by the common set of rules relating to pay and allowances read with 3(2) below, leave, passage and other general
conditions of service as laid down in Punjab Civil Service Rules as amended from time to time read with Rule 3(2) below. The employees recruited in Board‟s service on or after 1.1.2004 shall be governed by the New Pension Scheme of the Punjab Government as contained in Punjab CSR Vol.II
(2) (i) The employees shall be entitled to such scales of pay including special pay as may be sanctioned by the Board from time to time.
(ii) The employees shall be entitled to such allowances and concessions as may be sanctioned by the Board from time to time.
4. Cadre Strength :- The cadre strength of BBMB Class-I & II Officers will be 25% or existing cadre strength (whichever is higher) of sanctioned posts of BBMB own recruited employees. However where existing cadre strength is more than 25% the same will be tapered on occurrence of future vacancy and brought to 25%.
Provided that if shortfall occurs at any time, the partner states will be requested to provide officers against there share quota within stipulated time period i.e. 3-6 months and in case of failure to do so by the partner States, the adhoc promotions will be given to BBMB own recruited officers.
5. Mode of Appointment - (1) Appointment to the post(s) in the group(s) shall be made in the manner specified against each in Schedule „A‟ (containing groups I-XII) annexed with these regulations by
(A) Direct Recruitment :
(1) The direct appointment to Class II posts borne on the cadre of Bhakra Beas Management Board shall be made by the appointing authority on the recommendations of the Selection Committee. The partner states as per the share quota should have first right to provide the officers from there states for permanent absorption in BBMB at the induction level. In case of failure of the partner states to do so with in 3 to 6 months, BBMB will go ahead for the direct recruitment as per prescribed procedure.
(2) The Selection Committee shall advertise the vacancies through the press and shall hold written tests and or conduct interviews, as per the procedure approved by the Board from time to time and recommend the selected candidates for appointment.
B. Promotion:
(1) A Departmental Promotional Committee shall be constituted by the Board for filing up the vacant posts by promotion in the ratio of 25:75 between the BBMB regular employees and employees of Partner State Governments/Power Utilities working in BBMB respectively.
(2) Notwithstanding anything contained in these regulations appointment by promotion shall be made by selection based on seniority-cum-merit and no employee shall be entitled to such appointment as a matter of right.
6. Qualifications: No person shall be appointed to the service unless he possesses the essential qualifications and experience prescribed in Schedule „A‟ annexed with these regulations.
7. Departmental examinations and training- (1) The Board shall hold the departmental examinations as may be prescribed by the competent authority and considered essential for enabling the employees to discharge their duties, efficiently which the promotees and the direct recruits shall be required to pass within a period of two years of their appointment.
(2) The syllabus and procedure for holding the examinations under sub-regulation (1) shall conform, with marginal adjustments to suit the special conditions prevailing in the Board, to the standards laid down in the Punjab Irrigation Department and PSPCL & PSTCL.
Note: Detailed guidelines for the departmental examinations shall be prescribed and the instructions issued by the Chairman before conducting the first examination under these regulations.
(3) Failure to pass the departmental examination within the aforesaid period may result in reversion to a lower post in the case of a promotee and stoppage of further promotion and increment(s) in the case of direct recruit till the employee clears the prescribed examination.
(4) Annual increments including those with-held as above shall be allowed to an employee prospectively without arrears only on his passing the departmental examination where prescribed.
(5) The question of confirmation of an employee shall arise only after passing of the departmental examination and on successful completion of probationary period of two years.
(6) The employees shall also be required to undergo training in their respective field where considered essential for enabling them to discharge their duties efficiently in the interest of the Board.
8. Probation: (1) Persons appointed to any post in the service shall remain on probation for a period of two years, if recruited by direct appointment and one year if appointed by promotion;
Note:-
(a) Any period after such appointment, spent on deputation on a corresponding or a higher post shall count towards the period of probation.
(b) Any period of officiating appointment to the Service shall be reckoned as period spent on probation, but no person who has so officiated shall, on the completion of the prescribed period of probation, be entitled to be confirmed unless he is appointed against a permanent vacancy.
(2) If, in the opinion of the appointing authority, the work or conduct of a person during the period of probation is found not satisfactory, he may –
(a) if such person is appointed by direct appointment, dispense with his services; and
(b) if such person is appointed by promotion.
i) revert him to his former post; or
ii) deal with him in such other manner as the terms and conditions of his appointment permit.
(3) On the completion of the period of probation of a person and who has passed the departmental examination prescribed for that post, the appointing authority may,-
(a) if his work and conduct has, in its opinion, been satisfactory.
i) confirm such person from the date of his appointment if appointed against a permanent vacancy, or
ii) confirm such person from the date from which a permanent vacancy occurs, if appointed against a temporary vacancy; or
iii) declare that he has completed his probation satisfactorily, if there is no permanent vacancy; or
b) if his work and conduct has not been, in its opinion, satisfactory, -
(i) dispense with his service, if appointed by direct recruitment and if appointed by promotion revert him to his former post or deal with him in such other manner as the terms and conditions of his appointment permit; or
(ii) extend his period of probation and thereafter pass such orders as he could have passed on the expiry of the original period of probation;
Provided that the total period of probation, including extension, if any, shall not exceed two years in case of those appointed on promotion and three years in case of those appointed by direct recruitment. There shall be no deemed confirmation.
9. Nationality, domicile and character of person appointed to the service:- (1) No person shall be appointed to any post in the service of the Board unless he is:-
a) a citizen of India; or
b) a subject of Nepal; or
c) a subject of Bhutan; or
d) a Tibetan refugee who came over to India before the Ist January, 1962 with the intention of permanently settling in India; or
e) a person of Indian origin who has migrated from Pakistan, Burma, Sri Lanka or any of the East African countries of Kenya, Uganda, the United Republic of Tanzania (formerly Tanganika and Zanzibar), Zambia, Malawi, Zaire, Ethiopia
and Vietnam with the intention of permanently settling in India;
Provided that person belonging to any of the categories (b), (c), (d), or (e) shall be a person in whose favour a certificate of eligibility has been issued by the Govt. of India.
2. A person in whose case a certificate of eligibility is necessary may be admitted to an examination or interview conducted by the Selection Committee on his furnishing proof that he has applied for the certificate but he shall not be appointed to the service unless the necessary certificate is given to him by the Government of India.
3. No person shall be recruited to any post in the Service by direct appointment, unless he produces:-
a) a certificate of character from the Principal Academic Officer of the University, College, School or institution last attended if any, and similar certificate from two other responsible persons, not being his relatives, who are well acquainted with him in his private life and are unconnected with his University, College, School or institution.
b) an affidavit to the effect that he was never convicted for any criminal offence involving moral turpitude and that he was never dismissed or removed from service of any State Government or of Government of India or of any Public Sector Undertaking.
10. Age: No person shall be appointed by direct recruitment to a Class I & II post if he is less than 21 years of age or more than thirty five years of age on 1st July of the year in which the applications are invited by the Selection Committee or unless he is within such range of minimum and maximum age as may be specifically fixed by the Punjab Govt. and adopted by the BBMB from time to time.
The condition of upper age limit may be relaxed in the case of person already in employment of the Board, Partner State Govt./Elecy.Board or the Govt. of India.
Provided that in the case of candidates belonging to the Scheduled Castes, Backward Classes, Ex-Servicemen and Physically Handicapped persons, the upper age limit shall be relaxable as per the policy adopted by the Punjab Government in this regard from time to time.
11. Medical Fitness:- No person shall be initially appointed to the service by direct recruitment unless he produces a medical certificate of fitness from the prescribed medical authority as may be declared by the Board.
12. Reservation for the Scheduled Castes, Backward Classes, Ex-Servicemen, Physically handicapped persons and dependents of deceased employees in the Service:- The members belonging to the Scheduled Castes, Backward Classes, Ex-Servicemen, Physically handicapped persons and the dependents of deceased employees in the service, shall have the reservation in the service and all other concessions as prescribed by the Punjab Govt. from time to time. The provisions of the Punjab Scheduled Castes and Backward Class (Reservation) Act, 2006 shall be applicable.
13. Disqualification for appointment:- No person shall be eligible for appointment to any post in the service -
a) Who has previously been dismissed or compulsorily retired from the service of the Board or from any department of the State Govts. Or the Central Govt. or from any Public Sector Undertaking.
b) Who has been convicted in a Court of Law for any offence involving moral turpitude; or
c) Who-
i) has entered into or contracted a marriage with a person having a spouse living, or
ii) having a spouse living, has entered into or contracted a marriage with any person.
Provided that the Board may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other established grounds for so doing, exempt any person from the operation of this clause. Decision of the Board shall be final.
14. Seniority :- Seniority of members of the Service shall be determined by the length of continuous service on a post in the service.
Provided further that in the case of persons appointed by direct recruitment, the order of merit determined by the Selection Committee shall not be disturbed in fixing the seniority.
NOTE: In case of an employee whose period of probation is extended under regulation 8, the date of appointment for the purpose of this regulation shall be deemed to have been deferred to the extent the period of probation is extended.
15. Oath of allegiance. – Every member of the Service, unless he has already done so, shall be required to take oath of allegiance to India and to the Constitution of India as by law established.
16. Liability to transfer. – A member of the service shall be liable to transfer any where under the jurisdiction of the Board.
17. Deputation of employees of the Board to other organizations.- An employee of the Board may be sent on deputation or on foreign service to other organizations including the Central Government/State Governments/State Electricity Boards or any Public Sector Undertaking with his consent and prior approval of the Chairman. The deputation/foreign service of such an employee shall be governed by the terms and conditions prescribed by the Board for the purpose.
18. Code of Conduct.- Unless otherwise provided, the Punjab Government Employees Conduct Rules, 1966, as amended from time to time, shall apply to the members of the service.
19. Discipline, punishment and appeals.- In the matters relating to the discipline, punishment and appeals, members of the service shall be governed by the Punjab Civil Services (Punishment and Appeal) Rules, 1970, as amended from time to time.
Provided that the authority empowered to impose penalties under the aforesaid rules and the appellate authority for the purpose of Rule 16 thereof shall be Chairman, BBMB/Board.
20. Superannuation.- The age of superannuation for Board‟s employees shall be 58 years or as amended by Punjab Government from time to time.
21. Liability for vaccination and revaccination.- Every member of the service shall get himself vaccinated or revaccinated when so directed by general or special order by the Board.
22. Power of relax.- If the application of these regulations or any particular provision thereof is likely to cause substantial hardship in the case of any individual employee or class of employees, the Chairman/Board may,
by order, for reasons to be recorded in writing, relax the operations of the regulations or the particular provisions thereof, as the case may be.
23. Interpretation of the regulations.- If any question arises in regard to the interpretation of these regulations, the same shall be referred to the Board, whose decision shall be final.
24. Delegation of powers.- The Board may delegate any of its powers to the Chairman, BBMB with regard to the implementation, interpretation etc. of any of the regulations for efficient functioning of the BBMB.
25. Repeal and savings: Any rules/regulations applicable to the Service and corresponding to any of these regulations, which may be in force immediately before the commencement of these regulations, are hereby repealed.
Provided that any order made or action taken under such repealed rules/regulations shall be deemed to have been made or taken under the corresponding provisions of these regulations.
26. Administrative functions. - The Board or the Chairman as the Chief Executive of the Board may issue policy instructions not inconsistent with these regulations for the day to day administration of the affairs of the service.
