                Please refer your office memo.No.2654/BBMB/ALO-2787 dated 1.4.2013 vide which draft  regulation for BBMB own recruited Class-I&II officers have been put on web for comments of all concerned. We the qualified Drawing Establishment  employees of BBMB want to bring the following discrepancies appearing in the subject cited regulation in your kind notice to get issued the necessary amendments :-
The minimum experience for the Promotion of Assistant Engineers SDO/AEE under Group I Sr. No. 4 has been proposed under:-

                The requisite minimum experience for the posts is to be corrected as per PSEB (Now PSPCL) or HPSEB rules, moreover in any state for Drawing Establishment promotion CHD to SDO Qualification Degree / AMIE is not required only Experience counted for &In BBMB (PW) No HDM /CHD having the Qualification of Degree/ AMIE

                In nut-shell, the proposed regulation is indirect denial to legitimate right of BBMB allocated Drawing employees.
                It is, therefore, humbly requested to make above said amendments inproposed BBMB Class-I & II Regulation so that we the undersigned employees of BBMB may avoid harassment/mental agony/disparity & resultantly indulging in litigation.

We the qualified Clerical employees of BBMB want to bring the following discrepancies appearing in the subject cited regulation in your kind notice to get issued the necessary amendments :-
1.                         The minimum experience for the Class-I&II posts of Clerical cadre has been proposed under:-
                POST                          EXPERIENCE          
                Supdt. Gr.I :                 5 years service as Supdt.Gr.II.
                Under Secretary:          8 years service as Supdt.Gr.II. & Supdt.Gr.I.
                Deputy Secretary:        8 years service as Under Secretary.

                The requisite minimum experience for the posts is requested to be corrected as per PSEB(Now PSPCL) rules as under please:-
                Supdt. Gr.I :                 1 year service as Supdt.Gr.II.
                Under Secretary:          3 years service as Supdt.Gr.I. & Supdt.Gr.II.
                Deputy Secretary:        1 year service as Under Secretary.

                Because Class- III & IV Regulation-1994 of BBMB is exactly the same (adopted in to-to) as that of PSEB. In addition, since the BBMB came into existence, all perks/allowances/pay scales, 9-16 years TBS, revised pay scales are granted to BBMB employees exactly on the pattern of PSEB by adopting connected/concerned PSEB Circulars/Rules from time to time. Hence, requisite experience for promotion to Class-I & II posts should also be on PSEB (Now PSPCL) pattern for making justice with BBMB allocated employees.
                The proposed enhancement of requisite minimum experience in subject cited regulation 5-8 times is great in-justice with qualified clerical BBMB allocated employees whose services are regulated from the very beginning as per pattern of PSEB Rules/Regulations and it will have following adverse effects :-
a)             The proposed enhancement will block the channel of promotion of BBMB allocated qualified clerical employees because these employees will never be able to acquire requisite experience (enhanced to alarming extent). Most of the clerical employees were recruited by BBMB upto 1984 whereas BBMB Class-III Regulation was framed in Oct.-1994, consequently these employees were unable to qualify DAE

upto 1995 i.e. they have to spend 11 to 15 yrs. of their experience without getting promotion due to discriminating behaviour of BBMB authorities and no fault on their part. After such a long period 11 to 15 yrs and passing DAE the requisitie experience for promotion as LDC,UDC. Circle Asstt., Sr.Asstt., Supdt.Gr.II, as per BBMB Regulation amount to 18 years (2Yrs. For LDC+3 Yrs. For UDC+2 Yrs. For Circle Asstt.+3 Yrs. For Sr.Asstt.+8 Yrs.for Supdt.Gr.II). From above, it is evident that most of employees working as Sr.Asstt. & Supdt.Gr.II are on the verge of their retirement. Now again they are being deprived from their legitimate right of promotion to Class-II posts by enhancing minimum experience to alarming extent.

b)         State Electricity Board allocated employees working in BBMB will get 3 promotiono i.e. of Sssssupdt.Gr.I, Under Secy., Deputy Secy. during period of 5 yrs.( as per PSEB/HSEB Regulations) whereas BBMB own recruited employees will not be able to get even single promotion which will create disparity among PSEB/HSEB/BBMB employees working in same organization BBMB and having same nature of work, ultimately it will lead to litigation.

    c)         The enhancement of minimum requisite experience to 5-8 time as compared to that of S.E.Bs amounts to denial of right of BBMB allocated employees and is contempt of Pb.& Har. High Court judgement/orders issued in CWP No. 770 of 1996 titled Anil Kumar Vs BBMB decided on 11.2.2010 :

1)            BBMB allocated employees must be given preferenceover & above SEB employees & Ist available promotional post must be filled by BBMB allocated employees. As such, litigationwill increase manifolds. The large difference in minimum requisitie experience for State & BBMB allocated employees will be violation of above said orders of the Hon’ble High Court.

2.             The promotional quota of BBMB allocated employees may be restored to 33% (instead of 25% as proposed) because it will be against court’s orders and it is effort to snatch the promotional right to balance 8% (33% promoted fronm Class-III-25% proposed to be promoted as Class-II) BBMB allocated employees

3.             The posts of Supdt.Gr.I may be proposed as 100% promotional posts, instead of making provision of 40% direct recruitment because all DAE qualified clelrical staff (BBMB allocated ) is highly qualified (more than required for concerned posts) and are expert in working accoroding to BBMB rules due to long experience of 20-25 yrs.on various lower posts whereas MBA is education of different field and no link with BBMB working/rules.

                From the date when BBMB/PSEB came into existence, the posts of Supdt.Gr.I are 100% promotional posts & working of the concerned eligible employees have proved to be very good and remained helpful for smooth functiong of Board’s work as such the necessary amendement may be issued to avoid violation of court’s orders (for giving preference in promotion to BBMB allocated employees) so the posts of Supdt.Gtr.I may be proposed 100% promotional posts.

4.             The word ‘Selection instead of word promotion’ has been used for promotion as Under Secy. & Dy. Secy. Which also indicates doubtful intension of BBMB authorities about BBMB allocated employees whereas as per PSEB rules, posts of Under Secy., Dy.Secy. is filled up on the basis of seniority of Supdt.Gr.I.

5.             Engineering Cadre of BBMB(PW) has been proposed to be promoted on the basis of rules applicable in PSEB, whereas clerical cadre of BBMB (PW) has been proposed to be promoted on the basis of arbitrary rules being framed to snatch the right of clerical cadre. Till date promotional channel of BBMB(PW) clerical employees was exactly same as PSEB but now every effort has been made to snatch their legitimate right.

                In nut-shell, the proposed regulation is indirect denial to legitimate right of BBMB allocated clerical employees.

                It is, therefore, humbly requested to make above said amendments inproposed BBMB Class-I & II Regulation so that we the undersigned clelrical employees of BBMB may avoid harassment/mental agony/disparity & resultantly indulging in litigation.

महोदय,
                       उपर्युक्‍त विषय के सम्‍बन्‍ध में सन्‍दर्भित पत्र के आधार पर प्रस्‍तुत है कि भाखड़ा-ब्‍यास प्रबन्‍ध बोर्ड़ की वैबसाईट पर क्‍लास-I व क्‍लास-II अधिनियम का प्रारूप ड़ाला गया है व सभी सम्‍बंधितों से टिप्‍पणियां मांगी गई हैं । प्रारूप के पृष्‍ठ -18(समूह-4) पर वर्णित हिन्‍दी से सम्‍बन्‍धित पदों का विवरण दिया गया है । इन पदों के वेतनमानों के बारे में चिन्हित किया गया है कि इन पदों के समकक्ष पद क्रमांक 1 व 2 पी.एस.ई.बी. में उपलब्‍ध नहीं हैं, इसलिए उन्‍हें केन्‍द्रीय सरकार द्वारा जारी ज्ञापन सं. एफएन/1/2008-आई.सी, दिनांक 24.11.2008 में वर्णित वेतनमान दिये जा सकते हैं । इस ज्ञापन के आधार पर इन पदों को वेतनमान प्रदान करने का प्रावधान रखा गया है ।तुलनात्‍मक विवरणी निम्‍नानुसार है :-

(1)उक्‍त विषय में विनम्र निवेदन है कि उपर्युक्‍त वर्णित ज्ञापन में से वेतनमान नोट करते समय   त्रुटि हुई है, क्‍योंकि इस ज्ञापन में वरिष्‍ठ भाषा अधिकारी को उप-निदेशक (राजभाषा)के समकक्ष वेतनमान में रखा गया है । ज्ञापन में उप-निदेशक का ग्रेड़ पे- 6100/- व संयुक्‍त निदेशक का ग्रेड़पे- 6600/- रूपये निर्धारित  किया गया है । साथ ही इसी ज्ञापन का शुद्धि- पत्र दिनांक 27.11.2008 को जारी किया गया है व उसमें आंशिक संशोधन करते हुए उप-निदेशक को ग्रेड़ पे 6600/- एवं संयुक्‍त निदेशक को ग्रेड़ पे 7600/- रूपये प्रदान किया गया है । ( दोनों ज्ञापनों की प्रतिलिपियां आपके अवलोकनार्थ संलग्‍न हैं ) ।  यह भी सूचित किया जाता है कि हिन्‍दी अधिकारी, जिसे इस प्रारूप में क्रम सं.-3 पर अंकित किया गया है को सहायक निदेशक राजभाषा के समकक्ष रखा गया है, को बीबीएमबी के प्रस्‍तावित ड्राफ्ट में रूपये 4900/- का ग्रेड़ पे दर्शाया गया है, जबकि उक्‍त वर्णित ज्ञापन में सहायक निदेशक को 5400/- रूपयेका ग्रेड़ पे दियागया है । अत: उक्‍त वर्णित तथ्‍य को मद्देनजर रखते हुएहिन्‍दी अधिकारी को भी 4900/- के स्‍थान पर 5400/-रूपये का ग्रेड़ पेदिया जाए ।
(2)बीबीएमबी की वैबसाईट पर दिये गए विवरण के आधार पर यह भी प्रस्‍तुत है कि बीबीएमबीके अधीन छ: (6) मुख्‍य अभियन्‍ता व एक वित्‍तीय सलाहकार एवं एक मुख्‍य लेखाधिकारी के कार्यालय विभागाध्‍यक्ष  (हैड ऑफ डिपार्टमेंट) के रूप में कार्यरत हैं व वे इन अधीनस्‍थ कार्यालयों के स्‍वतन्‍त्र प्रभारी हैं। इस आधार पर कृपया बीबीएमबी में छ: हिन्‍दी अधिकारियों के पद उसी आधार पर सृजित किए जाएं, जिस आधार पर मुख्‍य अभियन्‍ता/ब्‍यास सतलुज लिंक (बी.एस.एल.) प्रोजेक्‍ट के कार्यालय के लिए किया गया है । 
                    अत: उक्‍त वर्णित तथ्‍यों के आधार पर आपसे सादर निवेदन है कि आप बीबीएमबी में क्‍लास-I व क्‍लास-IIके अधिनियम प्रारूप में पृष्‍ठ-18 पर हिन्‍दी से सम्‍बन्‍धित पदों में दिनांक 27.11.2008शुद्धि ज्ञापन पर वर्णित पदानुसार वेतनमानों को समाहित करनेएवं मुख्‍य अभियन्‍ता स्‍तर पर कम से कम वरिष्‍ठ भाजभाषा अधिकारीतथाहिन्‍दी अधिकारी के एक-एक पदों को सृजित करवाने काप्रावधान करकेअनुगृहीत करें ।
